General terms of use / Policies for the National Register of Procedures – Mitos
Navigating around and browsing the National Register of Procedures – Mitos (accessible at ‘en.mitos.gov.gr’) and the specific services offered to users thereof is subject to the following terms of use:
A. General
- This website contains data and offers services which belong to or are supervised or managed by the Ministry of Digital Governance or data and services which the Ministry is permitted to process and manage.
- Navigating around the National Register of Procedures – Mitos and using specific services offered by this website presupposes that the user unreservedly accepts the terms of use contained herein and/or more specific terms of use for each individual service contained in this document.
- Users must only browse the National Register of Procedures – Mitos and use the services offered for lawful purposes and in a lawful manner in accordance with the specific user instructions for each service.
- When interacting with the National Register of Procedures – Mitos users are obliged to refrain from malicious use of its software and systems, from any attempt to gain unauthorised access to the software system or subsystem and from any steps to authenticate themselves / log in to the portal’s services through the unauthorised use of login credentials.
- All users, whether citizens or civil servants, who enter the Mitos site to register procedures are personally responsible for safeguarding their login credentials. The Ministry of Digital Governance will confirm the particulars of users which are entered during the login process (authentication) or those used for the services of the General Secretariat of Information Systems for Public Administration (taxisnet), though one cannot rule out other authentication methods being used to create secure sites, using data obtained with the consent of the user data subject from third parties, or using highly secure data from personal smart devices.
- The Ministry of Digital Governance shall take all necessary measures, whether technical or organisational, to ensure to the greatest extent possible the accuracy of the information posted to the Website and the continuous and uninterrupted operation thereof, without being able to guarantee the completeness, correctness or continuity of the operation of the site. Changes to the content of information and data posted on the main host websites or to specific services on the portal software can be made at any time without users being actively informed about this.
- The terms of use, policies, restrictions imposed by the system shall be accepted, and consent for the transmission of personal data or refusals to that effect, whether specific or not, within the meaning of Regulation (EU) 2016/679 (GDPR) shall be given, after users are authenticated. Consequently, the terms cannot be contested and users bear the burden of proving system failure or force majeure or other serious reasons why the procedure did not lead to the specific user who used the service or the third party lawfully authorised by them being authenticated.
- It is recommended that users take all measures to protect the integrity and security of their own IT systems, hardware and software, so as to adequately protect login credentials and website usage data stored on the local storage media of user devices, whether portable or not. Any failure of user systems or leak of login credentials or usage data due to infection of the user’s operating system by malware shall not release the user from their obligations under these terms, shall not constitute force majeure or exceptional conditions nor shall it entail any liability of the Ministry of Digital Governance for the loss which the user may incur.
- Users are obliged to have the most recent version of the operating system and browser software installed to achieve the maximum possible interoperability of website software. Website software is structured and designed to interact with each browser and operating system. Technical constraints cannot be ruled out. This paragraph does not function as an interoperability guarantee since interoperability depends on the software each user has.
- Hyperlinks to other external websites may be posted on the website. These hyperlinks are only provided for the convenience of users and not as a list of websites whose content has been posted, approved or adopted in any manner by the Ministry of Digital Governance.
- The Ministry of Digital Governance shall not be liable for any loss (direct or indirect, actual or consequential) which users of the portal and the services provided via it may suffer from use or inability to use it, from delays in using it, from failures or omissions in it, irrespective of their cause, such as failures in telecommunications equipment or the quality of the internet connection, which are within the user’s own sphere of influence or that of the user’s third party telecom service provider.
- Where users engage in malicious acts or make improper use of the software and services on the website in breach of these terms and/or the relevant legislation, the Ministry of Digital Governance shall be entitled, in addition to taking steps to safeguard its lawful rights and sending a file to the competent authorities to investigate whether any criminal offences and any administrative infringements have been committed, to deactivate access for the user who engaged in the aforesaid unlawful conduct as an interim measure to protect the website. Removal of this restriction or objections concerning it shall be examined by the General Secretariat of Information Systems for Public Administration.
- In the case of force majeure which affects the operation of the website, as defined in the legislation and case law, the Ministry of Digital Governance shall be entitled at its unfettered and exclusive discretion to suspend the operation of the website and the services thereunder for such time as the force majeure persists, without being liable to users and without being obliged to notify users in advance about this matter.
- This policy – these terms of use and the specific sections hereof shall be deemed to have been fully accepted when the user is authenticated. Partial or qualified acceptance hereof is not permitted. Any refusal to accept the terms of use means users are obliged to cease all use of the website (browsing – navigation – logging in to use services).
- The Ministry of Digital Governance may amend these terms of use in whole or in part at its unfettered discretion. Any new codified and amended text shall apply once it is posted online, without any other conditions or without any need for deadlines or special procedures.
- Where any provision(s) of these terms of use are found to be invalid, such invalidity shall apply only to those provisions and shall not affect all provisions hereof.
- The competent courts of Athens shall be exclusively competent to hear any dispute which may arise from implementation of the terms of use and from actual use of the portal.
B. Option to comment on the implementation of a procedure via the National Register of Procedures – Mitos
- The free text in any comments posted online must not include humiliating, defamatory, offensive content, hate speech or content in general, disclosure of which constitutes a criminal act within the meaning of the Hellenic Penal Code and any other specific piece of criminal legislation. If that is not so, the provisions of these terms on improper use of the service shall apply. The Ministry of Digital Governance is entitled to carry out random checks of comments posted to the portal to ensure this and to improve the quality of service. One cannot rule out filtering methods being employed to prevent the use of such prohibited words or phrases.
- All data provided by users of the Public Administration’s Single Digital Portal is not used for any purpose other than that described in the terms of the specific portal/electronic service. The accuracy of data submitted by users is their own responsibility and any loss (direct or indirect, actual or consequential) which results from submission of inaccurate data shall be borne by users themselves and not by the Ministry of Digital Governance under any circumstances.
