The competent fire service (offices or local fire safety prevention and suppression departments) may issue a one-time temporary (active) fire protection certificate, after the submission of the respective application and supporting documents as indicated in Item 1 of Annex C to Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), accompanied by a reasoned report from the operator, to business undertakings and facilities that:

a) fall within the scope of Article 1(2) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but have not fully completed their obligation to install a permanent water-based fire suppression network or an automatic fire suppression system. b) fall within the scope of Article 1(2.1) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but for which deviations from the passive fire protection study description have been identified, which affect aspects of the active fire protection study (Annex B). c) fall within the scope of Article 1(2.2) and (2.3) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but which have not fully implemented their obligations with regard to integrated structural fire protection features. Unless otherwise stipulated by fire department or special fire protection provisions, the duration of the interim (active) fire protection certificate may not exceed six (6) months. Undertakings and facilities that have already been granted a temporary (active) fire protection certificate do not have the right to seek reissue. A prerequisite for the granting of a temporary (active) fire protection certificate is completion of the remaining fire protection measures and the installation of equipment provided for in the respective study. This certificate shall also specify any additional or increased fire protection measures and equipment required by the fire department and the deadlines by which they must be completed.

As of entry into force of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), paragraph 63 of Joint Ministerial Decision No 3021/19/6/1986 ‘Limitation of certificates and other supporting documents required by the current provisions for the processing of citizens’ cases by public sector services’ is no longer applicable (Government Gazette, Series II, No 847).

Issue of a temporary (active) fire protection certificate

Notes:

From the date of entry into force of the information system, in accordance with the accreditation act of the President of the TEI, provided for in the FPI No. PNEN/DACC/933111/3679/2021 Decision of the Secretary of State for Environment and Energy (B 4874), the procedure for the submission, verification, management and monitoring of the workflow for the adoption of this administrative fire protection acts shall be carried out electronically through the information system ‘E-Authorities’, upon request by an authorised engineer and the submission of the necessary documents and evidence. Access to the ‘E-Authorities’, with regard to the adoption of the administrative fire protection acts, shall be carried out through the Single Digital Portal of Public Administration (Gov.gr), which shall be used by all stakeholders in the procedures for the adoption of those acts, namely the competent Firefighting Services (Futures or Local DCFS). Access to ‘e-Licences’ for the issuing of administrative fire protection acts is via the Public Administration’s Single Digital Portal (gov.gr), which is used by all parties involved in procedures for issuing the abovementioned documents, namely the competent fire service (offices or local fire safety prevention and suppression departments) and authorised administrators.

        To revoke, amend or cancel the administrative act, the interested party may submit an application for remedy by administrative appeal, in accordance with the provisions of Article 24 of Law 2690/1999 (Government Gazette, Series I, No 45), as currently in force. The concept of structural fire protection refers to buildings subject to fire suppression or special fire protection provisions (Article 1(2.2) and (2.3) and Article 2 – Definitions as per Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519)). 6. In particular, pursuant to Article 8 of Law 41/2018 (Government Gazette, Series I, No 80), ‘... the project owner must keep a record of the certificates of materials and structural components installed in the building. With activation of the electronic identity of the buildings, the above certificates can be uploaded to the building’s respective electronic file and form an integral part thereof.’

Self-certification under Article 8 of Law 1599/86 (Government Gazette, Series I, No 75) by the owner-operator, employer or legal representative of the business undertaking or facility, that: a) The fire protection measures and active fire protection equipment, as provided for by the approved study and the fire safety legislation in force, which will be used by the undertaking or facility have been taken and installed, put into operation and are in good working order. b) Active fire protection equipment and systems have been maintained and shall continue to be maintained, in accordance with the requirements of the relevant national European standards, the manufacturers’ manuals and Fire Service Regulation No 12/2012 (Government Gazette, Series II, No 1794), as in force at any given time, and shall continue to be maintained, in accordance with the requirements of the relevant national European standards, the manufacturers’ manuals and Fire Service Regulation No 12/2012 (Government Gazette, Series II, No 1794), as in force at any given time. c) The facility’s personnel shall be organised, trained, and kept up to date on fire safety issues in accordance with the provisions of Fire Service Regulation 14/2014 (Government Gazette, Series II, No 2434), as in force at any given time. d) I am aware that I am obliged to inform a competent engineer prior to any potential alteration or modification of the installation or the provisions indicated in the study, or of any change in the hazard level of the existing facility, so that appropriate corrective measures or approvals can be undertaken or obtained. e) A copy of the fire protection technical file as notified to me by the competent engineer is available at the facility Solemn Declaration

              2.
